29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart: a)Runge Enterprises, Inc. at the area of Norbeck Street and north Crawford Road, Vermillion, SD 57069: On or about and at times prior to September 29, 2025, the employer did not ensure that employees hand digging around a new installation water line in an excavation greater than five feet in depth at the south end of a trench were adequately protected from cave-in hazards by allowable configurations for sloping and benching. This condition exposed employees to struck-by and cave-in hazards.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a)Runge Enterprises, Inc. at the area of Norbeck Street and north Crawford Road, Vermillion, SD 57069: On or about and at times prior to September 29, 2025, the employer did not ensure that employees hand digging around a new installation water line in an excavation greater than five feet in depth at the south end of a trench were removed from the trench when the competent person was aware protective systems (benching/sloping) may not have been appropriate. This condition exposed employees to struck-by and cave-in hazards.
