OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and caught-in-between hazards associated with a structural building collapse.  Leo's Builders, LLC at a jobsite located at 391 North Port Washington Road, Grafton, WI 53024:   (a) On or about November 14, 2025, employees were exposed to the hazards of being struck-by and crushed by the building components when walking and working beneath the previously set trusses and while performing truss setting operations. The employer did not ensure that the adequate bracing was provided for the metal plate connected wood trusses and walls of the newly constructed 60 foot long by 60-foot-wide building. The over 60-foot-long metal plate connected wood trusses were installed atop 16-foot-tall wooden framed walls.  (b) On or about November 14, 2025, employees were exposed to the hazards of being struck-by and crushed by the building components when lifting and placing the over 60-foot-long metal plate connected wood trusses atop 16-foot-tall wooden framed walls without the use of a spreader bar 2/3 to 3/4 truss length.

29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  (a) On or about November 14, 2025, at a jobsite located at 91 North Port Washington Road, Grafton, WI 53024, the employer had not provided the instruction manual for the 60' trusses installation in a language that the employees understood. This exposes employees to struck-by and caught-in-between hazards associated with a structural building collapse.

29 CFR  1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not independent of any anchorage being used to support or suspend platforms and/or were not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  29 CFR 1926.502(d)(15)(i): as part of a complete personal fall arrest system which maintains a safety factor of at least two; and  29 CFR 1926.502(d)(15)(ii): under the supervision of a qualified person.  (a) On or about November 14, 2025, at a jobsite located at 91 North Port Washington Road, Grafton, WI 53024, an employee performing truss installation work was tied off to a singular truss which was not capable of supporting at least 5,000 pounds as an anchor point. This exposes employee to a fall hazard of approximately 16 feet from truss to the concrete below.
