29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: On or about December 23, 2025, the employer failed to provide a safe means of egress from a excavation that measured approximately 6 feet in depth, greater than 25 feet in width and approximately 180 feet in length. Employees spray painting on stakes to identify the location of sewer lines, worked in an excavation without a safe means of egress. This condition increased the risk of entrapment and delayed escape during an emergency, exposing employees to cave-in hazards.

29 CFR 1926.651(e): Employees were not required to stand away from any vehicle being loaded or unloaded to avoid being struck by any spillage or falling materials: On or about December 23, 2025, the employer did not ensure employees were kept clear of loads being dumped by equipment, such as but not limited to: 644 K Front End Loaders. Employees were working inside a trench shield while 3/4" gravel was being placed inside. This exposed the employee to struck-by, crushed-by, and caught-in/between hazards if the shield shifted, was lifted, or if the gravel struck an employee.
