29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  (a) On or about 1/6/2026, on the north-facing flat roof, employees were more than six feet above the lower level while installing Thermoplastic Polyolefin (TPO) roofing material without using adequate fall protection.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.   (a) On or about January 6, 2026, on the north-facing flat roof, employees were more than six feet above the lower level while installing Thermoplastic Polyolefin (TPO) roofing material. The training provided to the employees did not address the safe utilization of personal fall arrest systems when this system was selected for the fall protection of employees.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
