The attachment point of the body harness shall be located in the center of the wearer's back near shoulder level, or above the wearer's head. (a) On or about January 13, 2026, at a construction site located at 110 Retzer View Court, Waukesha, WI 53188, employees were installing shingles on the south side of the roof of a new residential roof, were connected to the lines by the hip d-ring instead of the back d-ring. This exposed employees to muscular skeletal injuries in the event of a fall due to the positioning of the lanyard and a fall hazard of approximately 12 feet from roof to the ground below. (b) On or about January 13, 2026, at a construction site located at 110 Retzer View Court, Waukesha, WI 53188, employees were installing shingles on the east side of the roof of a new residential roof, were connected to the lines by the hip d-ring instead of the back d-ring. This exposed employees to muscular skeletal injuries in the event of a fall due to the positioning of the lanyard and a fall hazard of approximately 11 feet from roof to the ground below.

This exposed employees to a fall hazard of approximately 11 feet from roof to the ground below. (c) On or about January 13, 2026, at a construction site located at 110 Retzer View Court, Waukesha, WI 53188, an employee was retrieving bundles of shingles on the east side of the roof of a new residential roof with a 6:12 pitch, was not tied in. This exposed employees to a fall hazard of approximately 11 feet from roof to the ground below. Merino Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1827672, citation number 1, item number 1, and was affirmed as a final order on September 25, 2025, with respect to a workplace located at 1727 North River Circle, River Hills, WI 53217.
