OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck-by fragments of polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured: a. At the Workshop, located at 4033 SW Highway 358 in Steinhatchee, Florida 32359: On or about January 15, 2026, the employer exposed employees to struck-by hazards caused by the fragmentation of ruptured Polyvinyl Chloride (PVC) plastic pipes, in that the PVC pipes were used to distribute compressed air service at 115 pounds per square inch (psi), as employees utilized the compressed air directly from the PVC pipes for their assigned work, or while transiting the work areas where the PVC pipes were installed.

29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a. In the outdoor Yard area, located at 4033 SW Highway 358 in Steinhatchee, Florida 32359: On or about January 15, 2026, the employer exposed employees to struck-by and crushed-by hazards, in that a powered industrial truck (forklift) had one of it's two lifting forks modified to accept a Trailer Ball attachment, without the manufacturer's prior written approval, as employees operated the forklift to move equipment, such as but not limited to boat trailers, throughout the Yard.
