29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a- Building 16, Meridian Walk @ Princeton Development, West Windsor NJ: The company worksite Foreman was exposed to fall hazards, in excess of 9 feet 8 inches, when accessing to and egressing from a residential structure's entryway pitched roof using a portable, aluminum, extension ladder whose siderails did not extend at least three feet above the upper landing surface being accessed. Condition observed on or about 01/15/26.

Condition observed on or about 01/15/26. b- Building 16, Meridian Walk @ Princeton Development, West Windsor NJ: The company worksite Foreman was exposed to fall hazards when they were working and walking from a residential structure's unprotected window opening without fall protection. Condition observed on or about 01/15/26. New Contractor 1 Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1827042, citation number 1, item number 1 and was affirmed as a final order on August 14, 2025, with respect to a workplace located at 362 - 370 NJ 33 West, Manalapan NJ. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
