29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation:  a-  53 Aaron Truehart Way, Hopewell NJ:  Company workers and the company worksite Foreman were exposed to struck by hazards when using pnuematic nailers without eye/face protection at the worksite. Condition observed on or about 02/18/26.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii)   a- 53 Aaron Truehart Way, Hopewell NJ.  Workers and the company worksite Foreman were exposed to fall hazards when working and walking from a residential structure's pitched roofs without fall protection.  Five of these company workers had not received fall protection training as specified in 29 CFR 1926.503 (a)(2)(i) through (viii).  Condition noted on or about 02/18/26.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:     a- 53 Aaron Truehart Way, Hopewell NJ:  Workers and the company worksite Foreman were exposed to fall hazards, in excess of 11 feet 8 inches to the ground surface, when accessing to and egressing from a residential structure's pitched porch roof using a portable ladder whose side rails did not extend at least 3 feet above the upper landing surface being accessed to and egressed from. Condition observed on or about 02/18/26.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    a- 53 Aaron Truehart Way, Hopewell NJ:  A worker was exposed to fall hazards, in excess of 12 feet to the ground surface, when installing roof shingles, its underlayment materials, and performing other related activities from a damaged aluminum extension ladder. Condition observed on or about 02/18/26.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a- 53 Aaron Truehart Way, Hopewell NJ: Workers and the company worksite Foreman were exposed to fall hazards when working and walking from a residential structure's pitched roofs without fall protection. Condition observed on or about 02/18/26.  New Contractor 1 Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(10)), which was contained in OSHA inspection number 1827042, citation number 1, item number 1 and was affirmed as a final order on August 15, 2025, with respect to a workplace located at 362 - 370 NJ 33 West, Building 2, Manalapan NJ.
