29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about December 13, 2025, located at 530 6th St. NE, Naples, FL 34120, an employee performing while work on the roof was exposed to fall hazards; in that, the employer did not ensure that fall protection equipment was in use to prevent falls from a 15 ft. approximate elevation to ground level. Franco Plastering Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1711503, citation number 1, item number 1 and was affirmed as a final order on May 20, 2024, with respect to a workplace located at 2438 Indian Pipe Way, Naples, FL 34105.

29 CFR 1926.503(c)(3): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: a) On or about December 13, 2025, located at 530 6th St. NE, Naples, FL 34120, an employee while performing work on a sloped roof without fall protection was exposed to fall hazards exhibiting inadequate understanding of fall hazard recognition and fall protection methods; in that, the employer did not provide training to prevent falls from a 15 ft. approximate elevation to ground level. Franco Plastering Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1711503, citation number 1, item number 2 and was affirmed as a final order on May 20, 2024, with respect to a workplace located at 2438 Indian Pipe Way, Naples, FL 34105.
