Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Demolition of Building- Employees were operating two (2) Excavators at the project site. The Hitachi Excavator shovel were modified with 6 inch bolts with 1 to 2 nuts per bolts were used as pins. The Daewoo 225 LCV Excavator with a concrete breaker attachment was also modified with 4 inch bolts with 1 to 2 nuts per bolt were also used as pins. These bolts were used in place of the pins designed by the manufacturer to safety secure the bucket and attachments to excavators. AMOUNT OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD: 1.Follow the American Equipment Manufacturer's (AEM) "Safety Manual for Operating and Maintenance Personnel" which requires that damaged and missing parts are replaced, 2.Follow the Manufacturer's Operator Manual by using only service parts meeting manufacturer specifications, 3.Train operators and maintenance personnel to inspect equipment for defects and to complete service and repairs before equipment is placed back in service. KORANDO CORPORATION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD SECTION 5(a)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970 WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 113614366, CITATION NUMBER 2, ITEM NUMBER 1, ISSUED ON 10/19/2005, WITH RESPECT TO A WORKPLACE LOCATED AT AIRPORT TIYAN WATER LINE PROJECT, BARRIGADA, GUAM 96913. KORANDO CORPORATION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR EQUIVALENT STANDARD SECTION 5(a)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970 WHICH CONTAINED IN OSHA INSPECTION NUMBER 307375691, CITATION NUMBER 1, ITEM NUMBER 1, ISSUED ON 07/22/2004, WITH RESPECT TO A WORKPLACE LOCATED AT HIGHWAY PROJECT, DEDEDO, GUAM.
