Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Employees were exposed to the hazards of being crushed by or struck by the overhead guard and/or the mast, carriage, forks or frame of fork lifts in that there was no requirement for operators to wear seat belts on powered industrial trucks so equipped. One feasible and acceptable method to abate this condition is to make the use of seat belts mandatory anytime a powered industrial truck equipped with seat belts is being operated.
