Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling to the ground while working in an unsecured platform, lacking standard guardrails on all sides, and raised in the air by the forks of a powered industrial truck. a) On or about 6/18/02, in the north addition of the Main Plant: Employees were exposed to falls of approx. 4 ft. 3 in. while sealing furnace doors from a "homemade cage type workplatform" raised in the air by the forks of various forklift trucks. The workplatform was not secured to the truck. There was visible damage at the bottom, and the side closest to the furnace lacked guardrails. b) On or about 6/18/02, in the Main Plant: Employees were exposed to falls of approx. 4 ft. 3 in. while sealing "A" furnace doors from a "homemade cage type workplatform" raised in the air by the forks of various forklift trucks. The workplatform was not secured to the truck. There were no "pockets" for the forks at the bottom of the platform, and two sides lacked standard guardrails. Among others, a feasible method to eliminate or materially reduce this hazard is to: 1. Repair visible damage, & inspect workplatform for other damage. 2. Install properly sized chains or other means to fasten the workplatform to the forklift. 3. Have the cage & chains approved by a registered professional engineer. 4. install standard guardrails or the equivalent on all sides of the platform. 5. Redesign the cage so that the forks of the truck will be inserted into properly sized "slots" positioned at the bottom of the cage such that the platform is properly balanced when raising. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling loads suspended in the air by electric hoists for which a program of periodic & frequent inspections, and preventive maintenance had not been established. a) On or about 5/21/02, in the HPO dept., # 2 Room: Budgit Electric hoists are used to raise and lower "tumblers" into and out of acid tanks. No program of periodic & frequent inspections, and preventive maintenance had been established for these hoists. b) On or about 6/06/02, in the Maintenance Shop where Cincinatti Shear is located: Budgit Electric hoist on "underhung" crane is used to lift sheets of steel plate to be cut on the shear. No program of periodic & frequent inspections, and preventive maintenance had been established for this hoist. c) On or about 6/11/02, in the Weld Shop: Budgit Electric hoist on "underhung" crane is used to lift ductwork onto the weld table. No program of periodic & frequent inspections, and preventive maintenance had been established for this hoist. Among others, a feasible method to eliminate or materially reduce this hazard is to: 1. Establish a program of periodic & frequent inspections, and preventive maintenance based on the manufacturer's recommendations for these hoists. ABATEMENT CERTIFICATION REQUIRED
