Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Falls while climbing onto a roof, that was 14-feet above the ground level, by stepping from the railings of basket on the terrain forklift truck, without the use of a body belt and lanyard. a) On 7/19/05, at the Fleet Farm in Clintonville, WI, an employee climbed from the railing of the basket on the rough terrain forklift truck, without the use of fall protection, exposing the employee to fall injuries. This operation did not conform with the "ASME B56.6-2002 "Safety Standard for Rough Terrain Forklift Trucks: Section 5.15.1(u); "Personnel are to maintain firm footing on the platform floor unless secured by a body belt and lanyard. Use of railings, on the platform for purpose of achieving additional reach or height is prohibited". Among other methods, a feasible and acceptable means to correct the hazard would be to use an extension ladder to climb onto the roof. b) On 7/19/05, at the Fleet Farm in Clintonville, WI, the rough terrain forklift operator was not in position to control the truck and the truck wheels were not blocked, exposing the employee on the basket railing to fall injuries. This operation did not conform with the "ASME B56.6-2002 "Safety Standand for Rough Terrain Forklift Trucks: Section 5.15.1(s) "When the operator is not in the operating position, block the truck wheels". Among other methods, feasible and acceptable means to correct this hazard would be to block the wheels and apply the parking brake with all travel controls in neutral or to have the operator in position to control the rough terrain forklift truck. Abatement Certification required.
