Section 5(a)(1) of the Occupational Safety and Health act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious harm to employee in that employees were exposed to crushing hazards: Main Building and Yard: 1. The inside Hyster forklift # A010D056332 had the seat belts tied back and not useable. 2. The 2nd Hyster inside forklift with the unreadable data plate was not provided with seatbelts 3. The outside Hyster forklift had the seat belts tied back and not useable. Among other methods, one feasible and acceptable abatement method is to install a seat belt retro fit package on the forklift without seat belts, and require the use of seat belts on all forklifts when the trucks are operated.
