Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that, the yard
where the forklifts travel is not level (large holes in its surface),
exposing employees to crushing
injuries in the event of a forklift tip-over or other accident:
a) On or about May 29, 2007 and times prior, employees operating forklifts
were
exposed to
crushing injuries. There were holes in the yard surface that a forklift
could easily travel into
because of their (the holes) location and obscurity.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
would be to develop a reporting/audit system to search out this
conditions, then install temporary
protection (i.e. covers, barricades, etc.) until a permanent fix can be
installed..

forklifts:
a) On or about May 29, 2007 and times prior, employees operating forklifts
were exposed to
crushing injuries, in that emergency brakes were not fully functional,
numerous lights were not
operational, seat belts did not properly function, and horns were
inoperative.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to implement a preventative maintenance program in accordance with the
manufactures
recommendations.

was exposed to crushing hazards while working/walking next to loaded
forklifts:
a) On or about May 29, 2007, and times prior, employees were exposed to
crushing hazards
while operating forklifts in that employees are not properly trained on
the safe operation of
forklifts.
Among other methods, one feasible and acceptable abatement method to
correct this
hazardous condition would be develop and implement forklift training as
required by the
American National Standards Institute (ANSI) B56.1-1969 "Safety Standards
for Powered
Industrial Trucks" section 6, and as recommended by the forklift
manufacture.

employees to crushing
injuries in the event of a forklift tip-over or other accident:
a) On or about May 29, 2007 and times prior, employees operated forklifts
while not wearing
seat belts exposing them to serious injuries in the event of a tip-over or
other accident.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to ensure that employees are trained regarding the hazards associated with
not wearing seat belts
and to implement an active, effective enforcement policy.
