Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing hazards during operation of pneumatic drop hammers: a) DROP ROOM; A 1000 POUND PNEUMATIC DROP HAMMER OBSERVED IN USE ON 09/11/2007 WAS NOT EQUIPPED WITH ADEQUATE SAFEGUARDS TO PREVENT THE OPERATOR FROM HAVING ANY PART OF HIS BODY BETWEEN THE HAMMER AND DIE DURING OPERATION; AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE MEANS OF CORRECTING THE HAZARD WOULD BE THE INSTALLATION OF AN AUTOMATIC SAFETY GATE SYSTEM, WHICH DOES NOT ALLOW THE HAMMER TO DROP IF THE OPERATOR HAS ANY PART OF HIS BODY BETWEEN THE HAMMER AND DIE. ALTERNATIVELY, A HAND RESTRAINT AND OR PULLBACK SYSTEM THAT WOULD KEEP THE OPERATORS HANDS OUT OF THE HAZARD AREA WOULD ALSO BE ACCEPTABLE.
