Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from riding on an unapproved platform. Among other methods, one feasible and acceptable method to correct this hazard is: Use an approved platform designed by JLG Manufacturer in accordance with All-Terrain Forklift operations manual. a.On or about March 3, 2007, eastside of the site, the JLG All-Terrain Fork Lift was not being used in accordance with JLG manufacturers operation manual to lift personnel, employees were exposed to fall hazards.
