Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to caught in between or caught in the conveyor hazards: (a)Employees were exposed to caught in hazard by the conveyor system in the Lumper/Picker area of the shipping department, in that TRIUMPH FOODS, LLC had failed to install an audible device or devices that could be clearly heard or seen or understood at all hazardous points along the conveyor where personnel may be present as stated in ASME B20.1-2000, Section 5.11.2 (b)(1). The area had four floors and each floor had a separate start-up device. Employees were working on each of the four levels. Levels 1 and 2 were tied together and levels 3 and 4 were tied together. Employees could not tell where the line was shut off when the line started back-up. Only one audible warning horn located at level 1, sounded when the line started. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: Install an audible warning alarm at each floor of the conveyor system; therefore exposed employees on each floor will know when the conveyor system is starting as per ASME B20.1-2000. Abatement certification is required for this item - use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
