Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while being elevated on a work platform that did not meet acceptable safety requirements: a)A maintenance employee engaged in changing out various hoisting apparatus was using a work platform on the forks of a forklift. The work platform was not connected or attached to the forklift nor was the employee provided with adequate fall protection, such as a fully enclosed guardrail system or full body harness and lanyard, exposing the employee to a fall hazard of up to eight (8) feet onto the concrete floor. Among other methods, feasible and acceptable means to correct these hazards are to ensure that work platforms used in conjunction with forklift trucks meet the requirements of the American National Standards/Industrial Truck Standards Development Foundation (ANSI/ITSDF) Safety Standard for Low Lift and High Lift Truck, ANSI/ITSDF B56.1-2005: 1) Section 4.17.2(c): Whenever a truck is used to elevate personnel, the following precautions for the protection of the personnel shall be taken: Be certain that required restraining means such as railings, chains, cable, body belt(s) with lanyards, or deceleration devices, etc., are in place and properly used. 2) Section 4.17.3: Whenever a truck is equipped with a work- platform, the following additional precautions shall be taken for the protection of the personnel: (a) Provide a platform that complies with the requirements in paragraph 7.37.3., and; (b) The platform attachment means are applied and the platform is securely attached to the lifting carriages or forks.
