Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about August 25, 2009, and at times prior thereto, at the establishment located at 1405 Pace Road, Pocahontas, Arkansas, an employee was observed operating a Caterpillar C3599 powered industrial truck without the use of a seat belt, a condition that exposed employees to the hazards of being thrown from, struck by and/or crushed by the vehicle. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that employees utilize the existing seat belts while operating the vehicle as required by the Caterpillar operators manual and by ANSI/ITSDF B56.1-2005 Section 5.3.19.
