Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to wood dust fire and explosion hazards because methods were
not used to assure
proper collection of combustible wood dust during dust generation and
collection operations:
a.Manufactured Housing Enterprises, Inc. located in Bryan, Ohio:  On or
about April 27,
2010, the employer did not assure the duct work attached to woodworking
equipment
such as the horizontal belt sander, panel saw, radial arm saw, table saw,
and planer,
located in the cabinet shop was of metal construction.
b.Manufactured Housing Enterprises, Inc. located in Bryan, Ohio:  On or
about April 27,
2010, the employer did not assure the collected dust from the Jet
enclosureless dust
collector model# DC-5600, serial# 4117875, located in the cabinet shop,
was removed
daily to ensure efficient operation.
Among other methods, one feasible and acceptable method to correct this
hazard is to comply
with National Fire Protection Association (NFPA 664) "Standard for the
Prevention of Fires and
Explosions in Wood Processing and Woodworking Facilities" (2007),
including but not limited
to: a) Replace the existing PVC duct work with duct work of metallic
construction and adequate
design in accordance with Chapter 8 of NFPA 664 and b) Remove collected
dust daily or more
frequently according to Chapter 7 of NFPA 664.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the purchase
or repair of the equipment, photographic or video evidence, or written
records.
