Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards which were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to a fall hazard: a) On or about November 17, 2010, and at times prior, employees were exposed to a fall hazard at the personnel elevator hoistway landing (second landing up from bottom) where the hoistway opening was not protected by a gate. Among other methods, a feasible and acceptable method to correct this hazard is to install a gate at this opening in accordance with ASME A17.1-2007 which requires the use of gates to protect landing openings. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
