Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while on a powered industrial truck platform: On or about June 2, 20011, an employee was exposed to a fall hazard of approximately 8-9 feet while standing and squatting in a box elevated by a powered industrial truck to be lowered back down to ground level. Reference ANSI B56.1-2009.
