29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall beguarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards,shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operatingcycle. At Dadant & Sons, Inc., the Chicago Press Brake with the 6 foot bed did not have a guard that would prevent an employee from having his hands in the point of operation during the down stroke.

Employees at Dadant & Sons, Inc. were operating full revolution presses that did not incorporate a single-stroke mechanism on the following presses, exposing them to the hazard of amputation. a. The E.W. Bliss 30 ton press, identified as #7. b. The Rousselle 15 ton press, identified as #6. c. The Whitney-Jensen hole punch press, identified as #10.

29 CFR 1910.217(c)(1)(i): It shall be the responsibility of the employer to provide and insure the usage of "point of operation guards" or properly applied and adjusted point of operation devices on every operation performed on a mechanical power press. See Table O-10.\r\n\r\nAt Dadant & Sons, Inc., employees working with full revolution mechanical power presses are exposed to the hazard of amputation because the guards on the following presses are not adjusted to prevent the operator from getting their hands in the point of operation. a. The Rousselle 15 ton, press #6, had an opening larger enough for the operator to reach into the danger area. b. The Consolidated, press #3, had openings on the side of the guard for the operator to reach into the danger area. c. The notching press, press #5, had opening under the guard for the operator to reach into the danger area. d. The Whitney-Jensen, press #10, had opening under the guard for the operator to reach into the danger area.
