29 CFR 1926.1053(b)(8): Ladders placed in any location where they can be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, or a barricade was not used to keep the activities or traffic away from the ladder.    a. Hardy Roofing work site located at 964 Mallard Dr., Oregon, Ohio:  On or about October 13, 2011, the employer did not ensure the aluminum extension ladder used by employees to access a one story residential roof was properly secured to prevent the ladder from displacing.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails were not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access; or, when such an extension was not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, was not provided to assist employees in mounting and dismounting the ladder.  In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    a. Hardy Roofing work site located at 964 Mallard Dr., Oregon, Ohio:  On October 13, 2011, the employer did not ensure the aluminum extension ladder used by employees to gain access to the one story roof was extended above the edge of the roof at least three feet.    Hardy Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard    29 CFR 1926.1053(b)(1), which was contained in OSHA Inspection Number 311601900, citation number1,  item number 3 and was affirmed as a final order on March 31, 2008, with respect to a workplace located at 3175 Sterlingwood Ln., Perrysburg, Ohio.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    a. Hardy Roofing work site located at 964 Mallard Dr., Oregon, Ohio:  On or about October 13, 2011, the employer did not ensure employees tearing off the shingles and tar paper from a residential roof were protected from falling 115 inches to the ground below.      Hardy Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard  29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 311601900, citation number 1,  item number 1 and was affirmed as a final order on March 31, 2008, with respect to a workplace located at 3175 Sterlingwood Ln., Perrysburg, Ohio.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
