29 CFR 1926.95(a):  Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    a) Hardy Roofing, Bowling Green, Ohio:  On or about August 28, 2012, on the 1200 block of Cambridge Blvd., Bowling Green, Ohio, the employer failed to ensure that each employee used appropriate eye protection while engaged in nailing activities, such as securing shingles to the structure roof with a pneumatic nailer, exposing employees to eye injuries from flying particles.

29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Hardy Roofing, Bowling Green, Ohio:  On or about August 28, 2012, on the 1200 block of Cambridge Blvd., Bowling Green, Ohio, the employer did not ensure that employees were protected from falls while applying new roofing to a low sloped portion of a residential type structure.  Employees were exposed to a potential fall of approximately 13 feet to the ground below, which could result in permanent disability or death.      Hardy Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 107645, citation number 2,  item number 1 and was affirmed as a final order on January 5, 2012 with respect to a workplace located at 964 Mallard Drive, Oregon, Ohio.      Hardy Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 311601900, citation number 1,  item number 1 and was affirmed as a final order on April 21, 2008 with respect to a workplace located at 3175 Sterlingwood Lane, Perrysburg, Ohio.
