29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form or scrap lumber with protruding nails was not kept clear from work areas:    (a) On the ground level, 2 x 4 lumber with protruding nails lay against the stairway riser and directly in the path of travel of personnel walking to the second floor. The lumber was used as formwork and dismantled several days before this inspection. Employees were exposed to the hazards of nails impaling their feet.

29 CFR 1926.51(a)(4): The common drinking cup was not prohibited:    (a) At the second floor of the project site, disposable or personal cups were not provided or made available for employees.  Employees were sharing a common styrofoam cup at the work site.  Employees were exposed to potential health risks, which may potentially result in contracting communicable disease.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided:    At the project site, eye protection was not used while hammering a nail into a 2 X 4 piece of lumber. Employee was exposed to the hazards of nails or wood splinters striking their eyes.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    At the stairway landing between the 1st and 2nd floor, there was no fall protection for employees who were moving 4' X 8' drywall sheets from the ground level to the second floor. Employees were exposed to the hazard of falling from a height of about 7 feet 2 inches onto the ground below.
