Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a) On the jobsite: On or about November 8, 2011, and at times prior thereto, employees working in the street to remove a steel plate over a manhole were exposed to struck-by hazards from oncoming traffic as they were not using high-visibility clothing. Note: Abatement certification is required for this item. Abatement Note: One acceptable means of abatement would be to follow the Manual on Uniform Traffic Control Devices (MUTCD) 2009 Edition, Section 6D.03, Worker Safety Consideration, Subparagraph 4 on high-visibility apparel use.
