29 CFR 1910.23(c)(1):  Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides and railings were not provided with a toeboard where required:    a)  The first landing of the stairs to the attic was approximately ten feet above the first floor of the building and was not guarded by a railing to prevent employees from falling over the side.    b)  The railing around the walkway of the second level of the attic was not protected by a toe board.    c)  The walkway to the third level of the attic was approximately five stories tall, was not guarded by a standard railing, and the floor boards appeared to not be permanently attached to the supports below them.

29 CFR 1910.272(j)(1):  The employer did not develop and implement a written housekeeping program that established the frequency and the method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed areas.      (a)  On or about November 22, 2011 the employer did not have a housekeeping program in place for the Urbana, OH feed mill where fugitive grain dust had accumulated on beams, ledges, floors and equipment in the basement and attics area of the building.

29 CFR 1910.1001(j)(2)(i):  The building owner or facility owner did not determine the presence, location, and quantity of presumed asbestos-containing material (PACM) and/or other asbestos-containing material (ACM) at the work site:    On or about November 22, 2011 the building owner who had purchased the building in 2005, had not exercised due dilligence by determining the presence, location and quantity of PACM/ACM in the facility, which included:    (a)  Insulation on a pipe, approximately six feet above the floor, along the wall near the boiler room in the basement, which contained 40% asbestos;    (b)  Insulation on a fill tank, approximately four feet above the floor, outside the boiler room in the basement, near the grinder, which contained 66% asbestos;    (c)  Insulation on a fat tank, approximately eight feet tall and ten feet long, in the basement, near the mixer, which contained 10% asbestos;    (d)  Insulation on a pipe, approximately six feet above the floor, outside the boiler room in the basement, near the grinder, which contained 2% asbestos.

29 CFR 1910.1001(j)(2)(iii):  The building owner or facility owner did not inform employers of employees who performed housekeeping activities of the presence and location of asbestos containing material (ACM) or presumed asbestos containing material (PACM) in such areas that may be contacted during such activities:    On or about November 22, 2011 the building owner who had purchased the building in 2005, had not exercised due dilligence by notifying employees who performed housekeeping activities in areas that contained combustible grain dust of the presence and location of PACM/ACM in the facility, which included:    (a)  Insulation on a pipe, approximately six feet above the floor, along the wall near the boiler room in the basement, which contained 40% asbestos;    (b)  Insulation on a fill tank, approximately four feet above the floor, outside the boiler room in the basement, near the grinder, which contained 66% asbestos;    (c)  Insulation on a fat tank, approximately eight feet tall and ten feet long, in the basement, near the mixer, which contained 10% asbestos;    (d)  Insulation on a pipe, approximately six feet above the floor, outside the boiler room in the basement, near the grinder, which contained 2% asbestos.

29 CFR 1910.1001(j)(7)(iii)(C):  The employer did not ensure that each employee was informed of the quantity, location, manner of use, release, and storage of asbestos and the specific nature of operations which could result in exposure to asbestos:    (a)  On or about November 22, 2011 the employer had not ensured that each employee was informed of the presence of friable asbestos insulation on old pipes and tanks in the basement of the facility and how asbestos fibers could be released during maintenance activities on equipment located near the ACM or by sweeping and cleaning which was done to prevent the build up of combustible grain dust on a daily basis.
