29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)Needham Roofing, Inc. @ 2212 Vermont St., Fort Collins, CO 80525: On and before December 15th, 2011, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees on-site were permitted to work in areas where fall hazards existed. The condition exposed subcontractor employees to fall hazards of approximately 28 feet on the apartment complex's main roof. Subcontractor roofing employees were also working on secondary roofs without a fall protection system exposed to a fall hazard of approximately 10 feet. Subcontractor employee's were also utilizing inadequate ladders that did not extend 3 feet above the roof line. Needham Roofing, Inc.,was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(2) which was contained in OSHA Inspection Number 314280017, Citation Number 1, Item 1 issued on August 3rd, 2011, and became Final Order on September 16th, 2011, with respect to a workplace located at 1600 Village Dr., Euless, TX 76039.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection measure provided. (a)Needham Roofing, Inc. @ 2212 Vermont St., Fort Collins, CO 80525: On and before December 15th, 2011, the controlling employer did not ensure that fall protection systems were utilized by subcontractor employees engaged in roofing activities while working at the unprotected edges of a roof on a multi-family apartment complex. Employees were not utilizing a fall protection system. Employees were exposed to fall hazards of approximately 28' on the main roof. Employees were also exposed to fall hazards of approximately 10' on secondary roofs Needham Roofing, Inc. was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection Number 313722191, Citation Number 2, Item 1 issued on September 24th, 2010, and became Final Order on November 9th, 2010, with respect to a workplace located at 8153 W. Eastman Place, Lakewood, CO 80227.

29 CFR 1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid support, and a grasping device, such as a grabrail, was not provided to assist the employees in mounting and dismounting the ladder (a) Needham Roofing, Inc. @ 2212 Vermont St., Fort Collins, CO 80525: On and before December 15th, 2010, the controlling employer did not ensure that employees were utilizing portable extension ladders in such a way that enabled them to access and egress from work areas using ladders that extended 3' above the walking working surface. Subcontractor employees were using heavy duty portable extension-ladders for access to the roof. Subcontractor employees were exposed to a fall of approximately 28' while attempting to use the ladder to access the main roof. Subcontractor employees were also exposed to fall hazards of approximately 10 feet while accessing secondary roofs with inadequate ladders.
