29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: (a) On or about August 17, 2012, and at times prior, Needham Roofing, Inc., as controlling employer, did not ensure employees of Brothers Roofing, LLC were protected from eye hazards, in that employees were using pneumatic nail guns without eye protection while installing shingles on a roof. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: (a) On or about August 17, 2012, and at times prior, Needham Roofing, Inc., as controlling and exposing employer, did not ensure that its employees and the employees of Brothers Roofing, LLC, a subcontractor, were protected from fall hazards, in that the employees were roofing a three story apartment building without using any fall protection systems. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet"). Needham Roofing, Inc., was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent 29 CFR 1926.501(b)(10), which was contained in OSHA inspection 316094051, Citation 1, Item 1, issued February 14, 2012, with respect to a workplace located at 2682 Myrtle Springs Ave., Dallas, TX, 75220. This citation became final order on February 29, 2012. Needham Roofing, Inc., was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent 29 CFR 1926.501(b)(13), which was contained in OSHA inspection 313722191, Citation 2, Item 1, issued September 24, 2010, with respect to a workplace located at 8153 W. Eastman Place, Lakewood, CO, 80227. This citation became final order on October 19, 2010.
