29 CFR 1918.51(a): The safe working load of the ship's cargo handling gear, as specified in the cargo gear certification papers or marked on the boom, was exceeded:    At the StarKist Wharf located in Atu'u, American Samoa, on board a purse seiner, the Pacific Princess, during the unloading of skipjack tuna, the onboard crane was overloaded causing the crane to fail.  The weight of the cargo net filled with skipjack tuna was estimated to be 3,466 pounds each time it was lifted from the hatch of the Pacific Princess and lowered into 4 scows.  The load capacity of the crane at the angle and extension at the the time of failure was calculated at 2,492 pounds.  Safety Offshore Surveys, Inc. provided the Cargo Gear Certification for the 7500-pound capacity mid-ship starboard side crane.  The maximum safe working load was measured at 3,213 pounds without any boom extension or boom angle.

29 CFR 1918.98(a)(1):   An employee other than one determined by the employer to be competent by reason of training or experience, and who understands the signs, notices, and operating instructions and is familiar with the signal code in use was permitted to operate a crane, winch, or other power-operated cargo handling apparatus, or any power-operated vehicle, or gave signals to the operator of any hoisting apparatus:    At the StarKist Wharf located in Atu'u, American Samoa, on board the Pacific Princess, the crane operator did not follow conventional crane signal code as outlined in ANSI/ASME B30.5, when placing the skipjack filled cargo net over the scows located on the deck of the Pacific Princess.  The miscommunication to lower the crane boom from 45 degrees to approximately 35 degrees resulted in exceeding the capacity of the crane and the failure of the crane hydraulic cylinder.
