29 CFR 1910.95(c)(1):     The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment.    a) Production Department    The employer did not implement a continuing, effective hearing conservation program for employees working on GB20 Machine, Ring Machine, and Extruder Lines.  Employees were exposed to a continuous noise level that were equivalent to 89.2%, 73.9%, 92.8%, 72.8%, and 98.0% of the allowable dose of 100%, or 90 dBA.  These exposures, which were equivalent to an 8-hr TWA of 89.1 dBA, 87.8 dBA, 89.4 dBA, 87.7 dBA, and 89.8 dBA, respectively, exceeded the Action Level of 50%, or 85 dBA.  The sampling duration was 400 minutes, 440 minutes, 439 minutes, 439 minutes, and 439 minutes, respectively.  Zero exposure was assumed for the unsampled time period.    Violation occurred on or about 2/14/12.
