29 CFR 1926.602(a)(9)(i): Bidirectional machine(s) were not equipped with an operable horn, distinguishable from the surrounding noise level, which could be operated as needed when the machine is moving in either direction. (a) At the project site on or about February 24, 2012, and at times prior thereto, the Hyundai Wheel Loader, Model Number HL 740-7, Serial Number LF0111589 was being operated in the reverse position without an operable reverse signal/ backup alarm. While operating in the reverse position, the operator did not sound/activate the horn to warn personnel against potential struck-by hazards. Personnel walking behind the Wheel Loader were exposed to being struck-by the equipment.

29 CFR 1926.702(c): Manually guided powered and rotary-type concrete trawling machines were not equipped with control switches that would automatically shut off the power whenever the operator's hands were removed from the equipment handles: At the project site on or about February 24, 2012, and at times prior thereto, the manually guided Mikasa Power Trowel, Model Number MPT-36A, Serial Number Y 4836, was being operated with a defective deadman control switch. The cable to the deadman switch was binding, thus not allowing the control lever to retract to the SHUT OFF position. Employees were exposed to struck-by hazards from the potential uncontrolled power trowel.
