29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift. For work performed in the trench: On or about March 03, 2012, and at times prior thereto, the employer did not ensure that the competent person in charge on site conducted an inspection of the excavation before allowing employees to enter it, exposing the employees to the hazard of a cave-in. The Gonzalez Construction Enterprise, Inc., Company was previously cited for a violation of this Occupational Safety and Standard or its equivalent standard 9 CFR 1926.651(k)(1), which was contained in Inspection Number: 315629568, Citation Number: 01, Item: 003, issued on: 03/01/2012, and was affirmed as a Final Order on 03/23/2012, with respect to a workplace located at: HWY 36 & Columbus Rd, Sealy, TX 77474.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: For work performed in the excavation: On or about March 02, 2012, and at times prior thereto, the employer did not ensure adequate protective systems such as sloping, benching, or shielding were used to protect employees from a possible collapse of the excavation wall. The Gonzalez Construction Enterprise Inc.
