29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    The employer does not provide a ladder or other safe means of egress for trench excavations that are 4 feet or more in depth so as to require no more than 25 feet of lateral travel for employees. This violation was observed on or about August 20, 2013, at or near the end of Round Lake Dr. in Rosenberg, TX, where employees were exposed to a fall hazard when installing 48 inch storm drains in an 9 foot deep by 4 foot wide trench without a means of egress within 25 feet.       Gonzalez Construction Enterprise, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651 (c)(2), which was contained in OSHA inspection number 313038978, citation number 01 item number 001 and was affirmed as a final order on July 13, 2009 with respect to a workplace located at Ave D, Houston, TX.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a stairway, ladder, ramp or other means of egress is located in trenches that are 4 feet or more in depth so as to require no more than 25 feet of lateral travel for employees.

This violation was observed on or about August 20, 2013, at or near the end of Round Lake Dr. in Rosenberg, TX, where employees were exposed to a struck-by hazard when installing 48 inch storm drains in an 9 foot deep by 4 foot wide trench without the spoil pile being at least 2 feet from the edge of the excavation.      Gonzalez Construction Enterprise, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651 (j)(2), which was contained in OSHA inspection number 313038978, citation number 01 item number 003 and was affirmed as a final order on July 13, 2009 with respect to a workplace located at Ave D, Katy, TX.     Gonzalez Construction Enterprise, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651 (j)(2), which was contained in OSHA inspection number 313122731, citation number 01 item number 001 and was affirmed as a final order on July 13, 2009 with respect to a workplace located at Ave D and Katy-Hockley Rd, Katy, TX.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that protection is provided by placing and keeping excavated or other material or equipment at least 2 feet from the edge of excavations or by the use of retaining devices that are sufficient to prevent materials or equipment from rolling or falling into excavations or a combination of both.

Gonzalez Construction Enterprise, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652 (a)(1), which was contained in OSHA inspection number 313038978, citation number 01 item number 004 and was affirmed as a final order on July 13, 2009 with respect to a workplace located at Ave D, Katy, TX.       Gonzalez Construction Enterprise, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652 (b)(2), which was contained in OSHA inspection number 313122731, citation number 01 item number 002 and was affirmed as a final order on July 13, 2009 with respect to a workplace located at Ave D and Katy-Hockley Rd, Katy, TX.
