29 CFR 1910.178(a)(5): Where powered industrial vehicles equipped with front-end attachments other than factory installed attachments, the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with the load laterally centered: On March 8, 2012, and at times prior thereto, five foot extensions for the forklifts were used and the forklifts did not have a name plate to indicate the truck's lifting capacity.

29 CFR 1910.178(p)(1): Powered industrial truck(s) in need of repair, with defect(s) or in any way unsafe had not been withdrawn from service until it was restored to safe operating condition: MCCS Miramar Exchange: On March 8, 2012, and at times prior thereto, the employer did not ensure that forklifts in need of repair were not withdrawn from service. There were two Hyster forklifts on site with defects that include; A. Damaged seat cushions, with cardboard used instead on both forklifts. B. Cardboard used as a roof cover on the smaller forklift.
