29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    (a)  	Needham Roofing, Inc., 90 S. 18th Ave., Brighton, CO 80601:  On or before March 16, 2012, as the controlling employer, did not ensure that RPMX1000 (subcontractor) protected his roofing employees from fall hazards as they worked without fall protection. Four employees were conducting roofing operations from a Genie aerial lifts and were not wearing fall protection. This hazard exposed the employees to a fall of 30 to 40 feet.    Abatement Note: A personal fall arrest system is recommended with lanyard attached to the boom or basket when working from an aerial lift. 29 CFR 1926.454(a):  The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards:    (a)	Needham Roofing, Inc., 90 S. 18th Ave., Brighton, CO 80601  On and before  March 16, 2012, as the controlling employer, did not ensure that RPMX1000 (subcontractor) have each employee who performs work while on a aerial lift(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of aerial lift(s) being used and to understand the procedure(s) to control or minimize those hazards. Employees applied roofing materials while working from a Genie aerial lift. This condition exposed the employees to a fall of 30 to 40 feet due to not recognizing the hazards of working on the aerial lift.      Abatement Note: The training shall include the following elements at a minimum:    (1)  The nature of any electrical hazards, fall hazards, and falling object hazards in the work area;    (2)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used:    (3)  The proper use of the scaffold, and the proper handling of materials on the scaffold;    (4)  The maximum intended load and the load-carrying capacities of the scaffold used; and    (5)  Any other pertinent requirements of this subpart. 29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying hazards associated with aerial lifts).    (a)	Needham Roofing, Inc., 90 S. 18th Ave., Brighton, CO 80601:  On and before March 16. 2012, as the controlling employer did not ensure that RPMX1000 (subcontractor) had a competent person was onsite and evaluated the hazards associated with work using an aerial lift.     Needham Roofing, Inc.  was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(2) which was contained in OSHA Inspection Number 314280017, Citation Number 1 Item 1, issued on August 3, 2011 and became Final Order on September 2, 2011, with respect to a workplace located at 1600 Village Dr., Euless, TX 76039    Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

(a)	Needham Roofing, Inc., 90 S. 18th Ave., Brighton, CO 80601:  On and before March 16, 2012, as the controlling employer did not ensure that RPMX1000 (subcontractor) protected his roofing employees as they worked without head protection in areas where roofing operations were taking place at higher levels.       Needham Roofing, Inc.  was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.100(a) which was contained in OSHA Inspection Number 313722191, Citation Number 1 Item 1 issued on September 24, 2010 and became Final Order on November 9, 2010, with respect to a workplace located at 8284-8278 W. Eastman Pl., Lakewood, CO 80227.    Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
