29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites.      (a) At the 2nd floor (outside deck) on or about March 1, 2012, and at times prior thereto, there was no ground-fault circuit-interrupter protection or an assured equipment grounding conductor program when an extension cord was used to power a 110 VAC 1/2-inch DeWalt hammer drill, Model DW511.  The drill was used as a screw gun to fasten corrugated roofing panels onto metal studs.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:      (a) At the project site on or about March 4, 2012, and at times prior thereto, the aluminum extension ladder did not extend at least 3 feet above the wooden deck landing, as it extended about 4 inches above the wooden deck landing.  Employees utilized the ladder as the only access to the outside deck.  Employees were exposed to a fall hazard of about 10 feet to the ground below.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.      (a) At the project site on or about March 4, 2012, and at times prior thereto, the employer failed to provide training for each employee using ladders. Employees utilizing the aluminum extension ladder did not demonstrate the ability to recognize hazards associated with ladders.
