29 CFR 1926.451(a)(6):     Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordancewith that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) ofthis section.    On March 29, 2012, employees were exposed to a fall hazard at the construction site located on Interstate 35 near Trenton, MO in that the platform they were working from extended 24 inches outside of the wheelbase of the fork truck it was attached to.

29 CFR 1926.451(g)(4)(ii):     The top edge height of toprails or equivalent member on supported scaffolds manufactured orplaced in service after January 1, 2000 shall be installed between 38 inches (0.97 m) and 45 inches (1.2 m) above the platform surface. The top edgeheight on supported scaffolds manufactured and placed in service before January 1, 2000, and on all suspended scaffolds where both a guardrail and apersonal fall arrest system are required shall be between 36 inches (0.9 m) and 45 inches (1.2 m). When conditions warrant, the height of the top edgemay exceed the 45-inch height, provided the guardrail system meets all other criteria of paragraph (g)(4).    On March 29, 2012, employees were exposed to a fall hazard at the construction site located on Interstate 35 N near Cameron, MO in that the scaffold they were working on had guardrails that were installed at a height of 25 inches which did not fall in the required range of 38 to 45 inches.

29 CFR 1926.453(b)(2)(vi):     Boom and basket load limits specified by the manufacturer shall not be exceeded.    On March 29, 2012 at the job site located at Interstate 35 North near Cameron, MO  employees were exposed to a fall hazard in that the basket load for the aerial lift they were using was exceeded.  The load exceeded the manufacturers load limit of 500 pounds.

29 CFR 1926.501(b)(10):     "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section,each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall beprotected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrailsystem, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safetymonitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring systemalone [i.e. without the warning line system] is permitted.    On March 29, 2012 at the job site located at Interstate 35 North near Cameron, MO employees were exposed to fall from height hazards in that they were installing roofing materials on roof structure approximately 14 feet above ground level without the use of an approved fall protection system.

29 CFR 1926.602(c)(1)(viii)(A):     Use of a safety platform firmly secured to the lifting carriage and/or forks.    On March 29, 2012 at the job site located at Interstate 35 North near Cameron, MO an employee was exposed to a fall hazard while working from a platform located on the forks of forklift that were not attached securely.  No pins or chains were used to secure the platform.

29 CFR 1926.602(c)(1)(viii)(B):     Means shall be provided whereby personnel on the platform can shut off power to the truck.    On March 29, 2012 at the job site located at Interstate 35 North near Cameron, MO an employee was exposed to a fall hazard while working on a platform located on the forks of forklift in that there was no means to shut off power to the truck.  There were no controls on the platform, nor was anyone operating the forklift or in the area of the forklift.

29 CFR 1926.1053(b)(1):     When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder.  In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.    On March 29, 2012 at the job site located at Interstate 35 North near Cameron, MO employees were exposed to fall from height hazards in that  they were accessing and egressing the roof structure without the proper use of their ladder.  In that the ladder side rails did not extend at least 3 feet above the eve of the roof, nor was the ladder secured at the top.
