29 CFR 1910.134(e)(1):     The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    Machine and Carpentry Shops:  On or about May 1, 2012 and at times prior thereto, employees required to wear respiratory protection were not provided with a medical evaluation prior to use.  This condition exposed the employees to increased physiological burden depending on the type of respirator worn.    General industry standard applicable to shipyard employment.

29 CFR 1910.134(h)(2)(i):     Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:    Machine Shop:  On or about May 1, 2012 and at times prior thereto, various 3M half-mask, negative pressure, air-purifying respirators were stored in a manner which subjected the facepieces to contamination.  This condition exposed employees to dermal hazards from contact with the contaminated facepiece.    General industry standard applicable to shipyard employment.

29 CFR 1910.242(b):     Compressed air used for cleaning purposes was not reduced to less than 30 p.s.i.:    Machine Shop:  On or about May 1, 2012 and at times prior thereto, compressed air for four (4) compressed air guns utilized for cleaning measured at 110 p.s.i.g.  This condition exposed employees to air embolism hazards in the event of contact with the nozzle outlet.     General industry standard applicable to shipyard employment.

On or about May 1, 2012 and at times prior thereto, where there recordable injuries and illnesses for 2011 and 2012, the employer did not maintain the appropriate injury and illness recording forms.  This condition limited the employer's ability to adequately track injuries and illnesses in the workplace.
