29 CFR 1926.451(g)(1):     Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    On or about June 13, 2012 and times prior thereto, at the worksite located at or near 100 Crestwood Drive at the East side of bldg. 900 in Beebe, Arkansas, employees of Avila Framing, LLC were observed working from an elevated man basket while attaching siding to the exterior of the building.  An opening of approximately 142" across the front of the elevated man basket was not guarded, exposing employees to a falling distance of approximately 9-10 feet to the ground level below.

29 CFR 1926.451(c)(2)(iv):     Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:    On or about June 13, 2012 and times prior thereto, at the worksite located at or near 100 Crestwood Dr. in Beebe, Arkansas, east side of building 900, employees of Avila Framing, LLC were observed using an approximately 72" wide x 142" long x 72" high elevated man basket attached to a Skytrak 6036 to attach siding to the exterior of the building.  The man basket was not approved for use by the manufacturer for the observed use, exposing employees to tip-over hazards and a falling distance of approximately 9-10 feet from elevation.

On or about June 1, 2012 and times prior thereto, employees of Avila Framing, LLC were observed sheathing a roof on a two story apartment complex being constructed at or near 100 Crestwood Drive in Beebe, Arkansas.  The employees were exposed to falling distances greater than 6 feet and were not using fall protection.    Avila Framing, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 316070036, Citation Number 1, Item Number 4B and was affirmed as a final order on March 19, 2012, with respect to a workplace located at or near 8 Bruce Street in Morrilton, Arkansas.
