29 CFR 1926.300(b)(1):     When power operated tools are designed to accommodate guards, they shall be equipped with such guards when in use.    a.     At the front of the job site where an employee was mixing morter in a large morter mixer, the guard over the top of the mixer was missing while the mixer was in operation thereby exposing employees to a caught-in hazard.

On the northside of  Building B where an employee was observed working on a tuular welded frame scaffold, the working level was not fully planked thereby exposing the employee to a fall hazard.

29 CFR 1926.451(e)(1):     When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    a.     On the west side scaffold where employees gained access to the tubular welde frame scaffold, the hook n ladder did not reach high eough forcing employees to climb the side of the scaffold bucks to climb the additional three feet to gain access to the scaffold thereby exposing employees to a fall hazard.

29 CFR 1926.451(g)(4)(i):     Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.    a.    On Building A, Southeast side of the 3rd level of the scaffold where an employee was unloading brick from the pallet on the end of a rough terrain forklift, the employer did not ensure a guardrail was installed thereby exposing employees to a 20 foot fall hazard.    b.    On the west scaffold,  northwest side of the second level where employees were laying brick, the employer did not ensure guardrails were installed thereby exposing employees to a 11'6" fall hazard.

29 CFR 1926.451(h)(1):     In addition to wearing hardhats each employee on a scaffold shall be provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, or guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects. When the falling objects are too large, heavy or massive to be contained or deflected by any of the above-listed measures, the employer shall place such potential falling objects away from the edge of the surface from which they could fall and shall secure those materials as necessary to prevent their falling.    a.     On the site where bricks were laid from a tubular welded frame scaffolds, the employer did not take additional precautions to ensure employees would not be struck by bricks or equipment which could fall from the upper levels due to the employer failing to provide overhead protection such as, but not limited to to toeboards or fencing thereby exposing employees to a struck-by hazard.

29 CFR 1926.452(c)(5)(iii):     Be used only to support personnel, unless the scaffold has been designed for other loads by a qualified engineer and built to withstand the tipping forces caused by those other loads being placed on the bracket-supported section of the scaffold.    a.     On the west side scaffold where bricks were laid from a tubular welded frame scaffold, the employer used outrigger brackets to support a large bucket of mortar thereby exposing employees to a struck-by hazard.
