29 CFR 1926.1153(d)(2)(i): General. The employer shall assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section.  a. On or about February 15, 2019, the employer failed to assess the exposure to respirable crystalline silica and despite having a written training program, the employer did not ensure that two new hire employees were trained on respirable crystalline silica exposure, wet cutting methods when using a gas powered portable hand saw to cut block concrete. Hazards associated with exposure to silica include cancer, lung effects, immune system effects and kidney effects.

29 CFR 1926.1153(i)(1): Communication of respirable crystalline silica hazards to employees-Hazard communication. The employer shall include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200). The employer shall ensure that each employee has access to labels on containers of crystalline silica and safety data sheets, and is trained in accordance with the provisions of HCS and paragraph (i)(2) of this section. The employer shall ensure that at least the following hazards are addressed: Cancer, lung effects, immune system effects, and kidney effects.  On or about February 27, 2019, the employer failed to assure that two laborers who performed concrete masonry construction work received information and training in the hazards associated with crystalline silica under the provisions of the hazard communication standard. Hazards associated with silica exposure included cancer, lung effects, immune system effects and kidney effects.

The employer shall ensure that each employee covered by this section can demonstrate knowledge and understanding of the paragraphs (A)-(F) of 1926.1153(i)(2)(i):  On or about February 27, 2019, the employer failed to assure that two laborers who performed concrete masonry construction work received information and training required by this part. The employer did not train the employees in the health hazards associated with silica, the specific tasks with exposure to silica, specific measures such as engineering controls, work practices, and respirators to protect from exposure to silica, the contents of this section, the competent person designated by the employer and the medical surveillance program requirements of this section. Hazards associated with silica exposure included cancer, lung effects, immune system effects and kidney effects.
