29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: a) On June 7, 2012, or at times prior thereto, the controlling and exposing employer Keum Yang Corporation, failed to ensure the use of seatbelts when operating a John Deere 410G Backhoe, License Number 613 SEQ. Seatbelts are a component part of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a accident, and that the failure to wear the seat belts that are provided in the backhoe increases the risk of injury to the operator in the event of an accident. b) On June 7, 2012, or at times prior thereto, the controlling and exposing employer Keum Yang Corporation, failed to ensure the use of appropriate gloves while mixing and applying Portland cement. The Portland cement was mixed with water in a wheelbarrow and applied onto CMU blocks. The exposed employee wore gloves with a latex material on the palm side and a cotton mesh material on the other side instead of gloves made of a butyl or nitrile material.

29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage which could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. a) On June 7, 2012, or at times prior thereto, the operator of the operating a John Deere 410G Backhoe, License Number 613 SEQ, was operating the equipment in a condition where the operator did not have complete control over the acceleration and deceleration of the equipment. The accelerator mechanism was defective and did not allow for free movement as designed. The employer added a bungee cord in order to aid in decelerating.
