29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): a) 18 N Maple Ave., Marlton, NJ: Employees were exposed to fall hazards of greater than 21 feet while installing sheathing on a steep sloped (8 on 12 pitch) roof of a commercial business establishment. The employees were not provided adequate fall protection (PFAS, safety nets, guardrails, etc.). The employer had not initiated a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous position. Observed on or about 07/12/2012. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) 18 N Maple Ave., Marlton, NJ: Employees were exposed to fall hazards of greater than 21 feet while installing sheathing on a steep sloped (8 on 12 pitch) roof of a commercial business establishment. The employees were not provided adequate fall protection (PFAS, safety nets, guardrails, etc.). Observed on or about 07/12/2012. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
