29 CFR 1926.600(a)(3)(i): Bulldozer and scraper blades, end-loader buckets, dump bodies, or similar equipment were not fully lowered or blocked when being repaired or when not in use: (a) At the front of the house on or about July 18, 2012, and at times prior thereto, the rear bucket was not locked or fully lowered on a Caterpillar backhoe, license number 1173 SEQ. Employee walked next to the backhoe to access the project.

29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage which could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. (a) At the front of the house on or about July 18, 2012, and at times prior thereto, the drivers side signal light was defective, and the lens cover was damaged on the Caterpillar backhoe, license number 1173 SEQ. The backhoe was used to move soil around the site.
