In the boiler room where the main operations of the plant are performed for heating,  cooling and other tasks, the employer did not have a emergency eye wash and shower in an area where the corrosive Boiler Wash was used therby exposing employees to a contact hazard.

29 CFR 1910.212(a)(2):     General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself.      a.     In the tank isle area where the milk is received for processing, the plastic guard over the shaft to the CIP Pump was not secured from being dislodged from over the pump thereby exposing employees to a struck-by hazard.    b.      In the tank isle area where the milk is received for processing, the plastic guard to the HTST No. 2  pump was not secured from being dislodged from over the pump, thereby exposing employees to a struck-by hazard.    c.       In front of the Paturized Tank Number 1, the plastic guard over the rotating shaft of the milk pump was not secured from being dislodged from over the pump thereby exposing employees to a struck-by hazard.      d.       In the case room where the hydralic pump pushes the cases through the building to be cleaned, the guard over the coupler was not secured thereby exposing employees to a struck-by hazard.

29 CFR 1910.215(b)(9):     Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch. (See Figures O-18, O-19, O-20, O-21, O-22, and O-23.)       a.     In the engine room where maitenance was performed, the Black and Decker pedestal grinder had a one inch gap between the abrasive wheel and tongue guard thereby exposing employees to a struck-by hazard.

29 CFR 1910.219(e)(1)(i):     Where both runs of horizontal belts are seven (7) feet or less from the floor level, the guard shall extend to at least fifteen (15) inches above the belt or to a standard height, except that where both runs of a horizontal belt are 42 inches or less from the floor, the belt shall be fully enclosed in accordance with paragraphs (m) and (o) of this section.    a. In the gallon bottle filling area, there was a 440 volt energized electrical panel which had three circuit breakers missing from the panel thereby exposing employees to a contact hazard.    b.      In the gallon bottle filling area, there was a 440 volt energized electrical panel which had twelve missing circuit breakers from the panel thereby exposing employees to a contact hazard.    c.       On the north wall by the pint bottle filler area, there was a missing circuit breaker in the energized 220 volt electrical panel thereby exposing employees to a contact hazard.    d.       In the Trine Room, the Square D energized 220 volt electrical panel had a missing circuit breaker thereby exposing employees to a contact hazard.    e.        In the Trine Room, Panel No. 13 labeled Trine Labeler which was a 220 volt energized electrical panel had a missing circuit breaker thereby exposing employees to a contact hazard.    f.        In the regrind room, the south side of the grinder had an unused opening in the bottom of the energized 220 volt electrical junction box thereby exposing employees to a contact hazard.

Safety-related work practices shall be employed to prevent electric shock or other injuries resulting from either direct or indirect electrical contacts, when work is performed near or on equipment or circuits which are or may be energized. The specific safety-related work practices shall be consistent with the nature and extent of the associated electrical hazards.    a.     In the plant where employees routinely performed work on or near energized parts at 120 to 480 VAC such as, testing, troubleshooting, and voltage measuring, and other tasks, a flash hazard analasis was not performed to determine the proper protection required nor was a flash protection boundry established to protect employees from shock, arc flash or aec blast  thereby exposing employees to a contact hazard.      ABATEMENT NOTE:  One method of abatement amoung others, includes conducting a flash hazard analysis in compliance with NFPA 70E Standard for Electrical Safety in the Workplace (2004 Edition) Article 130.39 (or its equivilant), to determine the Flash Protection Boundry and the use of electric protective equipment necessary for the specific related hazards of the task being completed.
