OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from wooden trusses falling/swinging out of control due to improper hoisting by a crane: a) Southeast exterior and center interior areas; On or about August 29, 2012 and at times prior thereto, wooden roof trusses 36 feet wide were being hoisted into place by a crane with a single point of pick-up was being utilized. Note 1) Abatement certification IS required for this item.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b). Note: If using these systems was infeasible or created a greater hazard, the employer shall develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502. a) North side of structure at exterior wall; On or about August 29, 2012 and at times prior thereto, an employee laying out for and installing blocking was walking on/working from the top of the wall without a means of fall protection. b) Center area of structure, east exterior and west interior walls; On or about August 29, 2012 and at times prior thereto, three employees setting wooden trusses were walking on/working from the top of the wall and/or the bottom cord/webs of the trusses without a means of fall protection. Note: Abatement certification and documentation IS required for these items.
