29 CFR 1926.417(b): Equipment or circuits that were de-energized were not rendered inoperative: Secondary settling tank number 4 - The employer did not ensure that the motor controller for the settling tank mixing paddles and the sluice gate were tagged out or rendered inoperative with locking devices prior to permitting employees to work in the open top concrete tank, thereby exposing employees to hazards associated with working inside a sewage settling tank that was not mechanically locked out, on or about September 11, 2012. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
